These Online Sale Terms & Conditions (the “Terms”) govern every purchase made on the Site or in the Store, including discounted and promotional sales (“Sale Events”). By placing an order, you agree to these Terms and to our Privacy Policy and any posted policies such as Orders & Shipping and Returns & Refunds (collectively, the “Policies”).

1) Eligibility, Consumer Use

Purchases on the Site are intended for end consumers in the United States. We may refuse or cancel orders that appear to be for resale, exceed purchase limits, or violate these Terms.

2) Products, Availability, Pricing

Product images and colors may vary due to display settings. Dimensions/finishes are approximate.
All prices are in U.S. dollars and exclusive of applicable taxes, fees, and shipping.
We may change prices or correct errors at any time before acceptance (see §3).

3) Orders, Acceptance, Cancellations

Your order is an offer to buy. We accept only when we (i) charge your payment method and (ii) send a shipping confirmation.
We may decline or cancel any order (e.g., due to suspected fraud, inventory issues, pricing errors, purchase limits). If we cancel after charging, we will promptly refund the charge.
You may request order changes or cancellation before the order ships; once in fulfillment, changes are not guaranteed.

4) Payment, Taxes, Fraud

You authorize Demvel Panels to charge your selected payment method for the total order amount (including shipping, taxes, and fees).
You are responsible for any sales/use taxes we are required to collect.
We may use fraud-screening and may require additional verification or a different payment method.

5) Shipping, Delivery, Risk of Loss

We ship to U.S. addresses listed at checkout. Estimated delivery dates are not guarantees; actual timing depends on carrier capacity, weather, and order volume.

Risk of loss and title for items pass to you only when the order is delivered to the shipping address you provided and delivery is confirmed by the carrier (e.g., tracking scan, delivery photo, or signature). If the carrier confirms delivery but you believe you have not received the package, you must notify us within 3 business days so we can assist in investigating with the carrier.

If a package is lost or damaged before confirmed delivery, we will, at our discretion, replace the item or issue a refund. Please inspect packages upon receipt and retain all packaging for any claim. For a plain-language summary, see Orders & Shipping.

6) Damage, Shortage, or Incorrect Items

Report carrier damage or shortage within 5 business days of delivery and provide clear photos of the packaging and items. If photos are not provided, we may decline compensation.
For incorrect items, notify us within 7 days. We will provide instructions and, where confirmed, correct the shipment at our cost.

7) Returns & Exchanges (Full-Price Items)

Unless a product page or a Sale Event says otherwise, the following applies to full-price, non-sale items:

  • Return window: request a return within 14 days of delivery. Items must be new, unused, uninstalled, with all original packaging and accessories.
  • Authorization: contact us before returning anything. Unauthorized returns may be refused.
  • Return shipping: customer pays return freight unless the item is defective or we shipped the wrong item.
  • Outbound shipping deduction: if your order qualified for free standard shipping, the actual cost we paid for that outbound shipping will be deducted from your refund, in addition to any return shipping fees, unless the return is due to our error or a defective product. Outbound shipping costs vary by size, weight, and destination; contact us for an estimate before returning.
  • Refund method: refunds are issued only to the original payment method within 7–10 business days of receipt and inspection. We may refuse a return or deduct amounts for missing parts, damage, or signs of use.
  • Non-returnable: installed or modified items; custom-cut materials; gift cards; “final sale” or clearance items; sample swatches.

Florida disclosure: Our returns policy is posted conspicuously here and on relevant pages. If a return policy is not posted for a specific sale or product category, Florida law may imply a 7-day return for unused goods in original packaging unless an exception applies. This paragraph is for notice only; our posted return terms govern where provided.

8) Sale Events, Discounts, Price Adjustments

Unless a Sale Event page states otherwise:

  • Final Sale & Clearance - Items marked as “Final Sale” or “Clearance” are not eligible for return, refund, or exchange under any circumstances unless defective or otherwise required by law.
  • Other sale or promotional items - May be returned within 7 days of delivery only if unused, in original packaging, and in resalable condition.
  • Outbound shipping deductions - If you received free shipping on your order, our actual standard shipping cost will be deducted from your refund unless the item is defective or otherwise required by law.
  • Return shipping fees - The customer is responsible for the cost of return shipping unless the item is defective or we shipped the wrong product.

Other conditions: “Prices as marked” - Unless we specify a discount code, sale prices already reflect all applicable discounts. Sale offers cannot be combined with other discounts, codes, or price adjustments on prior purchases. While supplies last - We may limit quantities and may end a Sale Event early due to inventory. Processing time - During Sale Events, please allow an additional 5–7 business days for order processing before shipment.

9) Installation & Use

Our standard products are designed for customer installation. Follow all instructions and safety guidance. Improper installation, misuse, or modifications void any remedy to the fullest extent permitted by law.

10) Warranties, Disclaimers

Unless a written limited warranty is expressly provided with a product, products are provided “AS IS” and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the maximum extent permitted by law. Some states do not allow limitations on implied warranties; if so, these limitations apply only to the extent allowed.
If a written limited warranty is provided for a product, that document controls and will be read together with these Terms.

11) Limitation of Liability

To the maximum extent permitted by law, Demvel Panels will not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to lost profits, business interruption, or loss of data, arising from your purchase or use of our products, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to a purchase will not exceed the amount you actually paid for the product(s) at issue. Some states do not allow certain limitations on liability; if so, these limitations will apply only to the extent permitted by law.

12) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (including supply chain disruptions, labor actions, acts of God, or carrier failures).

13) Governing Law, Venue

These Terms and any dispute arising from a purchase on the Site are governed by the laws of the State of Florida, without regard to conflicts of law. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Palm Beach County, Florida. You and Demvel Panels waive any right to a jury trial to the extent permitted by law.

14) Changes to Policies

We may update these Terms and our Policies from time to time. Changes apply to purchases placed after the effective date of the update. The version posted at checkout governs each order.
